Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420 of the Indian Penal Code.
The prosecution case is that informant being Manager of Shalimar Hatchery, Muzaffarpur supplied chicken and poultry feed to the poultry farm being look after by the petitioner but subsequently petitioner sold 1677 chicken and thereby caused loss of Rs. 2,00,922/-.
It is submitted by learned counsel for the petitioner that it was the informant who took 1577 chicken without any receipt and subsequently the accusation has been levelled.
A statement has been made in para 3 of the
Patna High Court Cr.Misc. No.34277 of 2015 (2) dt.25-08-2015 2/2 petition that petitioner has no criminal antecedent. Considering the accusation levelled in the background of contractual relationship between the parties, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Muzaffarpur in connection with Kurhani P.S. Case No. 202 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
