Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Khaira P.S. Case No. 406 of 2021 lodged under Section 392 of the I.P.C.

As per the prosecution, F.I.R. has been lodged against three unknown persons with allegation of snatching the motorcycle of the informant after assaulting him. Learned counsel for the petitioner submits that the petitioner is in custody since 12.05.2022 and charge sheet has already been filed in this case. He further submits that there is two criminal cases pending against the petitioner in which he is

Patna High Court CR. MISC. No.53926 of 2022(3) dt.21-02-2023 2/2 on bail. Counsel further submits that nothing was recovered from possession of the petitioner nor he was put on T.I.P.. Learned counsel for the State opposes the prayer for bail and submits that an affidavit has been filed on behalf of Superintendent of Police, Jamui in which it has been stated that the said looted motorcycle was recovered form the house of coaccused Bikaram Kumar and the said Bikaram Kumar disclosing the name of petitioner and his involvement in the crime.

In this view of the matter, I am not inclined to grant bail to the petitioner. Accordingly, the bail petition of the petitioner is hereby rejected.

Liberty is hereby granted to the petitioner that he may renew his prayer for bail after framing of charge. (Dr. Anshuman, J.) ravishankar/- U
