JUSTICE JITENDRA KUMAR ORAL ORDER 29-08-2025 The present writ petition has been preferred by the petitioners for direction to the State authorities to protect the life, liberty and property of the petitioners in the light of land dispute between the petitioners and the private respondents.

2. From perusal of the case record, it transpires that there is land dispute between the petitioners and the private respondents and for that sake, the petitioners have right and liberty to move competent Civil Court to adjudicate their disputes and as per further pleading in the petition, they have already moved competent Civil Court in regard to their civil disputes. There is reference to threat to their life and liberty and for that sake, the petitioners have liberty to approach local Executive Magistrate for taking preventive measures under Criminal Procedure Code against the private respondents. Moreover, in case, any offence is committed, there is always

3. Considering the aforesaid facts, the present petition is liable to be dismissed as not maintainable.

4. At this stage, learned counsel for the petitioners is seeking permission to withdraw the present petition with liberty to take steps as per law before the competent authority.

5. Permission is accorded.

6. Accordingly, the present petition is dismissed as withdrawn with the aforesaid liberty as sought for by learned counsel for the petitioners.
