2. The petitioners are apprehending their arrest in Muffasil P.S. Case No. 881 of 2023 registered under Sections 341, 323, 307, 379, 504, 506/34 of the Indian Penal Code.
3. Allegedly, while the informant was in his field, the petitioners along with others equipped with lathi and danda came there and started assaulting him. The petitioner No. 2 is alleged to have assaulted the informant on his head.
4. It has been submitted on behalf of the petitioners that the petitioners have falsely been implicated in the present case. From perusal of the injury report, it appears that the injuries are
Patna High Court CR. MISC. No.56020 of 2024(3) dt.20-09-2024 2/2 simple in nature. There is no specific allegation against the petitioner No. 1 and so far as petitioner No. 2 is concerned, though there is allegation against him to assault the informant on his head but the injury suffered is simple.
5. On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.
6. Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Muffasil P.S. Case No. 881 of 2023, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Nawneet Kumar Pandey, J) A.K.V.//- U T
