The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324 and 307/34 of the Indian Penal Code. The prosecution case is that on 03.03.2016 at 8.30 P.M. the petitioners along with co-accused Ravindra Mistry assaulted with knife on the back of the informant. It is submitted by learned counsel for the petitioners that the injury report contained in Annexure-2 reflects that one lacerated injury has been found simple in nature
Patna High Court Cr.Misc. No.25263 of 2016 (2) dt.21-06-2016 2/2 caused by hard and blunt substance. It is further submitted that for the occurrence of 03.03.2016 the FIR was registered on 08.03.2016 on the basis of the written report submitted on 08.03.2016. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the delayed lodging of the case and the accusation not being corroborated with the medical opinion, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Patna in connection with Ram Krishna Nagar P.S. Case No. 54 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
