KUMAR ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 03-08-2022 Petitioner has prayed for the following relief/s : "for quashing the decision of the Technical Bid Committee dated 06.10.2021 in
Patna High Court CWJC No.18741 of 2021(3) dt.03-08-2022 2/3 terms of which the tender of the petitioner in relation to work under MMGSY (SC) for construction of Road MMGSY Road to Yadav Tola (Tender ID 93545) under work Division Mauradha have been held to be unsuccessful/disqualified on the ground of not enclosing the detailed of other roads in the Existing Commitment and the amount of earnest money in the form of NSC has been pledged for years back i.e. on 05.02.2016 which is not in consonance with the five criteria laid down in the letter No. 4842 dated 14.11.2014 issued by the Rural Works Department, Bihar.
ii) For quashing the decision of the Financial Bid Committee dated 18.10.2021.
iii) For quashing the work order issued in relation to Tender ID 93545 on 21.10.2021 in favour of the M/S D.D.
Construction.
iv) To stay the process of agreement to be executed in relation to Tender ID 93545. v) To direct the respondent authorities to proceed to consider the technical bid of the petitioner as the responsive and thereafter again to open the financial bid in relation to the Tender ID 93545.
vi) To stay any further process in relation to the Tender ID 93545.
vii) To any other relief or reliefs for
Patna High Court CWJC No.18741 of 2021(3) dt.03-08-2022 3/3 which the petitioner is found to be entitled is found to be entitled in the facts and circumstances of the case."
