24-06-2021 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Rajpur P.S. Case No. 189 of 2019, registered for the offence under Section 302 of the Indian Penal Code.

As per the prosecution case, on 18.08.2019, this petitioner is alleged to have stabbed with knife to the deceased , as a result of which, he died.

It is submitted on behalf of petitioner that petitioner is none else but father of the deceased and on account of family feud, some quarrel took place and out of grave and sudden provocation, the occurrence took place. There was no motive to kill the deceased. Petitioner has got clean antecedent and he is in custody since 18.08.2019.

Patna High Court CR. MISC. No.9760 of 2021(3) dt.24-06-2021 2/2 However, learned A.P.P. for the State opposed the bail petition and submitted that there is specific allegation of against this petitioner of stabbing the deceased with knife, as a result of which, he died.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected.
