====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-10-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. Petitioner seeks regular bail in connection with Kotwali P. S. Case No. 333/2022 in a case registered for the offences punishable under Sections 147, 148, 149, 323, 337, 338, 307 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, on 12.6.22 at about 11 PM, informant got information that two communities are scuffling with each other and when informant reached at the place of occurrence, 19 F.I.R. named and 100-150 unknown persons were found in indulged in brick batting as a result of which, some of them sustained injuries.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.55957 of 2024(3) dt.18-10-2024 2/2 petitioner has got no concern with the alleged occurrence and he has falsely been implicated in this case. There is no allegation of specific overt act against petitioner. Petitioner is in custody since 28.05.2024. Charge-sheet has already been submitted.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate 1st, Gaya in connection with Kotwali P. S. Case No. 333 of 2022.
