1. Heard learned counsel for the petitioner and Mr. Chandra Bhushan Prasad, learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 118(1), 303(2), 352, 351(2) and 3(5) of the BNS.

3. The Superintendent of Police, Sheohar, in compliance of the order dated 07.10.2025, is present in the Court.

4. The Superintendent of Police, Sheohar, at the outset, submits that the offences for which the instant FIR has been instituted carry punishment of seven years and less. It is further submitted that the Investigating Officer of the case has not performed his duty rather there was a dereliction of duty, as such, he has been issued show cause.

5. The Superintendent of Police, Sheohar assures the

6. Learned counsel appearing on behalf of the petitioner based on the assurance given by the Superintendent of Police, Sheohar seeks permission to withdraw the anticipatory bail application with liberty to file afresh, if need arises.

7. Permission is accorded.

8. Accordingly, the instant anticipatory bail application is dismissed as withdrawn in connection with Purnahiya P.S. Case No. 74 of 2025 pending in the Court of learned Sub-Divisional Judicial Magistrate, Sheohar/Successor Court.

9. The personal appearance of the Superintendent of Police, Sheohar is dispensed with.
