The petitioner apprehends his arrest in Marhowrah P.S. Case No. 517/2015, registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

The informant named four persons namely, Dinesh Singh, Biran Singh, Shiv Nath Mahto, Paras Mahto and alleged that they all surrounded his uncle. Dinesh Singh fired causing death of his uncle.

It is submitted that the petitioner is not named in the F.I.R., but during the course of investigation many witnesses disclosed that the petitioner also made firing on the uncle (deceased) of the informant.

Patna High Court Cr.Misc. No.25818 of 2016 (2) dt.24-08-2016 2/2 The petitioner has got criminal antecedent.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
