JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-06-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 353, 379, 171(C), 171(F) of the Indian Penal Code and Section 130(2), 13(b), 135(a) of the Representation of People Act.

The prosecution case is that the informant being Presiding Officer of Booth No. 146, Primary School, Badhai Tola at Mohiuddinagar Block submitted a written report to the S.H.O, Mohiuddinagar Police Station to the effect that on 24.04.2016 during the polling of panchayat election 50-60 people tried to cast bogus votes and thereafter they poured water in the ballot box. The accused persons also took away some papers and other documents. On suggestion of some people seven persons were named in the F.I.R including the

Patna High Court Cr.Misc. No.25633 of 2016 (2) dt.28-06-2016 2/2 petitioner and 50-60 persons have been described as unknown. It is submitted by learned counsel for the petitioner that accusation is omnibus and general and only on suspicion the petitioner has been roped in the present case. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail till conclusion of the investigation on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Chief Judicial Magistrate, Samastipur in connection with Mohiuddinnagar P.S. Case No. 66 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
