The petitioner seeks regular bail in connection with Turkaulia (Raghunathpur) P.S. Case No. 150 of 2018, G.R. Case No. 1385 of 2018 for the offences punishable under Sections 379 and 420 of the Indian Penal Code.
The allegation is regarding change of ATM card of the informant by the unknown accused persons and thereafter withdrawal of money by the ATM card of the informant. The learned counsel for the petitioner has submitted that the petitioner was arrested in Motihari Town P.S. Case No. 381 of 2018 and thereafter he has been remanded in the present case without any basis. It is further submitted that neither any
Patna High Court Cr.Misc. No.70534 of 2018(2) dt.12-12-2018 2/2 recovery has been made nor there is any material on record to connect the petitioner with the alleged crime. It is stated that barring the aforesaid Motihari Town P.S. Case No. 381 of 2018, in which the petitioner is on bail, the petitioner is having a fair antecedent and is languishing in custody since 2.7.2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Turkauliya (Raghunathpur) P.S. Case No. 150 of 2018, G.R. Case No. 1385 of 2018.
