The petitioner seeks bail in anticipation of his arrest in connection with Gamhariya P.S. Case No. 149/2020 instituted for the offences under Sections 307, 324, 323, 354, 379, 504, 506/34 of the Indian Penal Code. The petitioner and others are said to have assaulted the informant. The victim has received three injuries, two of which have been found to be simple in nature. However, the third injury is said to be grievous as it is in the nature of fracture of the leg of the victim. The learned counsel for the petitioner has

Patna High Court CR. MISC. No.9913 of 2021(2) dt.21-12-2021 2/3 submitted that several persons are said to have indulged in assaulting the members of the prosecution party. The occurrence took place because of a small issue of an animal straying in the field of one of the parties. There is a counter version of the occurrence also vide Gamhariya P.S. Case No. 148 of 2020.

Regard being had to the fact that the petitioner has not been attributed with any specific accusation and many persons are said to have assaulted the informant, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Madhepura, in connection with Gamhariya P.S. Case No. 149/2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
