JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-12-2018 The petitioner seeks regular bail in connection with Khagaria P.S. Case No. 603 of 2018, registered for offences punishable under Sections 399, 402 of the Indian Penal Code and Sections 25(1-B)(a), 26 and 35 of the Arms Act. Allegation as per F.I.R. is that the police on information that some persons have assemble and making preparation for committing dacoity, raided the place and apprehended four persons including petitioner and it is said that from possession of the co-accused Gulab Yadav, one Katta has been recovered and from the possession of the petitioner one mobile has been recovered.
It has been submitted on behalf of the petitioner that he has falsely been made accused in this case only on the basis
Patna High Court Cr.Misc. No.71840 of 2018(2) dt.07-12-2018 2/2 of suspicion and only a mobile has been recovered from his possession. Further he has no criminal antecedent and has been in judicial custody since 07.09.2018.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, in connection with Khagaria P.S. Case No. 603 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
