====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 21-08-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offences punishable under Sections 147, 148, 149, 353, 337, 338, 323, 324, 307, 504, 506, 120B of the I.P.C. and Section 27 of the Arms Act.

For land dispute, co-accused Bablu Pandey along with his associates had gone to capture the land. Bablu Pandey had disclosed name of the petitioner as co-perpetrator of the crime. Submission is that the petitioner was in jail in connection with some other case and on disclosure statement of Bablu Pandey, the petitioner was booked in this case. Several other co-accused have been allowed anticipatory bail by a coordinate Bench of this Court vide order at Annexure-2.

No.10238 of 2021(3) dt.21-08-2021 2/2 Considering the facts aforesaid and completion of investigation, specially no overt-act alleged against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Chanpatia P.S. Case No. 214 of 2018, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
