The notice issued to the sole opposite party have been validly served.

The petitioner is the wife of the opposite party, namely, Pradeep Kumar Rai @ RakeshRai, who has filed this application for transfer of Matrimonial(Divorce) Case No. 115 of 2018 from the Principal Judge, Family Court, Samastipur to any competent Court at Darbhanga.

The petitioner is a young lady dependent upon her old and ailing parents. It is causing much inconvenience to her to travel to Samastipur from Darbhanga to contest the matrimonial case along with her girl child.

Considering the facts of the case, the Matrimonial Case No. 115 of 2018 is directed to be transferred from the

Patna High Court MJC No.2933 of 2019(5) dt.12-10-2022 2/2 Principal Judge, Family Court, Samastipur to Principal Judge, Family Court, Darbhanga .

After transfer of the case in the Court of Principal Judge, Family Court, Darbhanga, the Principal Judge, Darbhanga, will issue notice to both the parties and, thereafter, the proceeding will continue in the Court of Principal Judge, Family Court, Darbhanga.

However, learned counsel for the sole opposite party has vehemently opposed the prayer for transfer of the case. With the aforesaid observation and direction, this application is allowed.
