1. Learned counsel for the petitioners, after arguing vehemently for some times realizing his difficulty, seeks permission to withdraw the prayer for anticipatory bail with respect to petitioner no. 1, namely, Talu Hansda @ Iliyas Hansda.

2. Permission is accorded.

3. Accordingly, the prayer for anticipatory bail with respect to petitioner no. 1 is dismissed as withdrawn.

4. Heard learned counsel for the petitioners no. 2 and 3 and learned A.P.P. for the State.

5. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 191(2),

Patna High Court CR. MISC. No.53503 of 2025(2) dt.19-08-2025 2/3 191(3), 190, 126(2), 115(2), 118(1), 109(1), 76, 352 and 351(2) of the BNS.

Learned counsel for the petitioners submits that petitioners no. 2 and 3 are persons with clean antecedent and the informant alleges that accused persons blocked his road on account of which an altercation took place and petitioner no. 3 assaulted the informant by an iron rod causing injury on head while Daniyal Hasda assaulted Raju Marandi by sword causing injury on his hand and leg. Thereafter, Fulman Hasda assaulted Ram Marandi by axe causing injury on his head and Talu Hasda assaulted Sumi Murmu by knife causing injury on her head while Seema Tudu (petitioner no. 2) snatched silver chain from Sumi Murmu.

Learned counsel for the petitioners submits that from perusal of the allegation as alleged in the FIR, it would manifest that on account of dispute relating to blockage of road, an altercation took place in which the side of the petitioners are alleged to have assaulted the informant and his side. It is further submitted that injury of Ram Marandi and Sumi Murmu are opined to be grievous and the injury suffered by the other injured is opined to be simple. It is next submitted that allegation of assaulting Ram Marandi and Sumi Murmu is

It is also submitted that petitioner no. 2 is a woman and has been implicated in the instant case only with a view to coerce the male members of her family into submission and the injury suffered by the informant on account of assault by petitioner no. 3 is opined to be simple in nature.

8. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners no. 2 and 3, let the petitioners no. 2 and 3 above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/Successor Court in connection with Pothia P.S. Case No. 71 of 2025, subject to the conditions as laid down under Section 482(2) of the BNSS.
