Patna High Court Cr.Misc. No.35624 of 2015 (2) dt.20-08-2015 2/3 CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 20-08-2015 Heard learned counsels for the petitioners and the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 379, 506 of the Indian Penal Code and 27 of the Arms Act.

It is alleged that the accused persons made indiscriminate firing but no injury was caused to anyone when the accused persons harvested the wheat crops of the informant. It is submitted by learned counsel for the petitioners that in the background of land dispute and 144 Cr,P.C. the accusation has been levelled when petitioners' side earlier lodged Complaint Case No. 130 of 2015 against the informant side.

Considering the accusation being omnibus and general and a statement that the petitioners have no criminal antecedent, let the above named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand)

No.35624 of 2015 (2) dt.20-08-2015 3/3 each with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Biraul at Benipur, District - Darbhanga in connection with Kusheshwar Asthan P.S. Case No. 124 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
