JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-12-2018 Earlier prayer for bail of the petitioner was dismissed vide order dated 13.04.2017, passed in Cr. Misc. No. 16911 of 2017 in connection with Panapur P.S. Case No. 83 of 2016, for the offences punishable under Sections 147, 148, 149, 341, 323 and 302 of the Indian Penal Code and there is allegation against the petitioner and others is of catching hold of the deceased allowing co-accused Sonu Rai to give farsa blow on the head of the deceased.

Submission of learned counsel for the petitioner is that he has been in judicial custody since 30.07.2016 and other similarly situated co-accused has already been enlarged on bail by the coordinate Benches of this Court vide order dated 20.12.2017 passed in Cr. Misc. No. 61203 of 2017 and vide order dated 26.04.2017 passed in Cr. Misc. No. 7663 of 2017.

Having heard both sides, considering the facts and circumstances of the case and also the fact that similarly situated co-accused has already been enlarged on bail, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - XI, Saran at Chapra, in connection with Panapur P.S. Case No. 83 of 2016, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
