JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-09-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 504 and 379/34 of the Indian Penal Code and under the provisions of SC/ST (Prevention of Atrocities) Act.
The prosecution case is that the informant along Ram Ekbal Ram, Amit Ram and Tengari Ram went for fishing in the pond then the petitioners did not allow the fishing in the pond when on protest being made, the informant was abused by calling caste name.
It is submitted by learned counsel for the petitioners that
Patna High Court Cr.Misc. No.33748 of 2015 (2) dt.03-09-2015 2/2 the accusation has been levelled in the background of dispute with regard to fishing in the pond which is a public pond used for irrigation purpose. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Rohtas at Sasaram in connection with Kargahar P.S. Case No. 167 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
