JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-12-2018 Petitioner prays for bail in connection with Dulhin Bazar P.S.Case No. 215 of 2018, giving rise to Special Case No.7592 of 2018, registered for the offence punishable under Section 30(A) of Bihar Prohibition and Excise Act, 2016. Allegation against the petitioner is of recovery of 45 litres of liquor from the motorcycle and two accused persons were arrested, who disclosed the name of the petitioner as owner of the motorcycle.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case, having no criminal antecedent and nothing has been recovered from his conscious position and he is in custody since 6.10.2018. Heard learned APP also.

No.69687 of 2018(2) dt.05-12-2018 2/2 Having heard both sides and in the facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Patna, in connection with Dulhin Bazar P.S.Case No. 215 of 2018, giving rise to Special Case No. 7592 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
