JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 23-12-2021 Learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioners as well as the learned APP for the State.

The petitioners apprehend their arrest in connection with Panjwara P.S. Case No. 75 of 2020, registered for the offences punishable under Sections 447, 323, 427, 498(A), 504, 506, 34 of the Indian Penal Code.

The informant Akanksha Kumari has levelled allegation against her husband, her in-laws and other family members that they subjected her to cruelty and demanded dowry. It has further been alleged that her husband has illicit relation with her gotni.

No.10400 of 2021(2) dt.23-12-2021 2/2 Learned counsel for the petitioners has submitted that the petitioner No. 1 is sister-in-law (nanad) and petitioner No. 2 is brother-in-law (nandoshi) of the informant. They have no concern with day to day affairs of the matrimonial dispute between the couple. He has further submitted that the husband of the informant Dilip Sah, has been granted bail by the learned Session Judge, Banka in B.P. No. 801 of 2020 vide order dated 06.11.2020 which is annexed with the record as Annexure-2, from perusal of which it appears that the informant herself prayed to the court to release her husband on bail.

Considering the above-mentioned fact and circumstances, let the petitioners be released on bail in the event of their arrest or surrender within four weeks before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate/Successor Court, Banka in connection with Panjawara P.S. Case No. 75 of 2020, the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey , J) SONALI/- U T
