The petitioner seeks bail in connection with Ahiyapur P.S. Case No. 922 of 2018, registered under Sections 399, 402 and 414of the Indian Penal Code and Section 25 (1-b)a, 26, 35 of the Arms Act.
The accusation is that on receiving the secret information about gathering of miscreants for making the plan of loot, the informant being the Officer-in-Charge of Ahiyapur Police Station along with other Police personnel reached there and apprehended 4 persons, who disclosed their names as Vishal Pandey, Amit Kumar, Prahlad Kumar and Navneet Singh, while some persons succeeded to flee away. On search, one dagger and one mobile found in possession of the
Patna High Court Cr.Misc. No.71379 of 2018(2) dt.04-12-2018 2/2 petitioner, while fire arms were recovered from the other apprehended persons.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent and he is in custody since 31.08.2018.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No. 922 of 2018, subject to the condition that one of the surety must be parent/close relative of the petitioner.
