JUSTICE PARTHA SARTHY ORAL ORDER 10-06-2021 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Sitamarhi P.S. Case No. 355 of 2020 registered under sections 20 and 22 of the N.D.P.S. Act.

As per allegation in the F.I.R., on a raid being conducted, different quantities of charas etc. was recovered from different accused persons. It is stated that 110 grams of charas was recovered from the possession of co-accused, Raja Raut and 150 grams from the possession of this petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the person

Patna High Court CR. MISC. No.10084 of 2021(2) dt.10-06-2021 2/2 or possession of the petitioner. He has been falsely implicated in the case. Co-accused Raja Raut has been enlarged on bail vide order dated 1.6.2021 passed in Cr. Misc. No. 9748 of 2021. The petitioner is in custody since 13.7.2020.

The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, quantity of the article recovered, the petitioner having remained in custody for nearly 11 months and grant of bail to co-accused, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Sitamarhi P.S. Case No. 355 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Sitamarhi.
