The petitioner seeks regular bail in connection with Khagaria (Mufassil) P.S.Case No.96 of 2013 dated 16.2.2013 registered for offences punishable under Sections 324, 307/34 of the Indian Penal Code.

Allegation against the petitioner is that on the order of the petitioner some other accused persons fired causing injury to the sister of the informant. It further appears that the case is of the year, 2013. The petitioner was named in the FIR but now he has appeared on 18.9.2018.

Submission of the learned counsel for the petitioner is that he is only order-giver and other accused persons have been granted bail by this Court, which will appear from the

Patna High Court Cr.Misc. No.73825 of 2018(2) dt.14-12-2018 2/2 impugned order itself and he is in custody since 18.9.2018. Heard learned A.P.P. also, who has opposed the prayer for bail stating the conduct of the accused shows that he is evading for last five long years.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, once the charge is framed in this case, the petitioner is at liberty to renew his prayer for bail.

With the aforesaid observation, this application is dismissed.
