The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 147, 341, 342, 323, 325 and 379 of the Indian Penal Code. As per the prosecution case, it is stated that eight named accused persons including the petitioner herein over a dispute between the parties assaulted the informant and others who came to his rescue. It is stated that Arbind Singh and Deepu Singh assaulted the cousin brothers of the informant while the petitioner is stated to have taken away Rs.5000/- It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. Patna High Court CR. MISC. No.65025 of 2021(2) dt.07-01-2022 2/2 nature. He is in custody since 31.7.2021 and has no criminal antecedent. Chargesheet has been submitted in the case. Heard learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the facts of the case, the nature of allegation against the petitioner in the F.I.R. together with the petitioner having remained in custody for over 5 months, the Court directs the petitioner to be enlarged on bail in connection with Bakhtiyarpur P.S. Case no. 144 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate III, Barh.
