JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-07-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 504,379, 307/34 of the Indian Penal Code.

The prosecution case is that on 18.02.2016 the petitioner and his brother-in-law along with two unknown persons reached at the courtyard of the informant and petitioner assaulted the informant's brother, Ajay Kumar Ranjan, with Rami on his head and he repeated the blow four times and took away gold chain of the informant. The genesis of occurrence was dispute with regard to irrigating land.

It is submitted by the learned counsel for the petitioner that the informant retracted from his earlier version and filed a

Patna High Court Cr.Misc. No.28278 of 2016 (2) dt.14-07-2016 2/2 petition to that effect before the court below. Statement has been in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the genesis of the occurrence and retracted version of the informant, in view of this court, it is a case for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Surajpura P.S. case No. 12 of 2016 pending before learned Sub-divisional Judicial Magistrate, Bikramganj, Rohtas.

This application is disposed of with the aforesaid observation/ direction.
