It appears that by order dated 08.07.2022, the anticipatory bail petition as against petitioner no.4 has already stood dismissed as withdrawn.

Heard the learned counsel for the petitioners and learned APP for the State.

Patna High Court CR. MISC. No.63195 of 2021(3) dt.20-09-2022 2/3 Petitioner nos. 1 to 3 apprehend their arrest for the offences alleged under Sections 341, 323, 307, 334, 379, 427, 504 and 506/34 of the Indian Penal Code, registered in connection with Turkauliya (Raghunathpur O.P.) P.S.Case No. 752 of 2020.

The informant made allegation that he was constructing his new house in place of his old house and he was coming in peaceful possession over the property since 1970. In the meantime, the accused persons named in the FIR came there, abused him in filthy words and they slapped him and demanded Rs. 5,00,000/- as Rangdari. They also snatched Rs. 45,000/- from his pocket.

The learned counsel for the petitioners has submitted that there is land dispute between the parties. He has submitted further that petitioner no.1 namely, Vijayanand Ram @ Vijay Ram was repairing his boundary wall in Khata No. 205, Plot No. 599. In the meantime, the informant and his persons came there and they claimed the above-mentioned land to be their own land. There is civil dispute between the parties. It appears that there is land dispute between the parties. The petitioner are the persons of clean antecedent. Considering the above facts and circumstances, let the

No.63195 of 2021(3) dt.20-09-2022 3/3 petitioner nos. 1 to 3, s above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of learned CJM, East Champaran at Motihari in connection with Turkauliya (Raghunathpur) P.S.Case No. 752 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
