This application for regular bail arises out of Kursela P.S. Case No. 68 of 2021, disclosing offence punishable under Sections 394/411 of the Indian Penal Code.

The petitioner is in custody since 26.05.2021. It is alleged in the F.I.R. that three miscreants had snatched the informant's laptop, register and a bag containing cash. On resistance, they attempted to flee away in a motorcycle, however, having lost balance, they started fleeing on foot. On chase, a police party arrested one of them, namely, Baski Mandal. Said Baski Mandal, in his confessional statement before the police is said to have disclosed the petitioner's name

Learned counsel for the petitioner has submitted that there is no recovery of any incriminating material from the petitioner's possession whose name has surfaced only on the basis of confessional statement of a co-accused. Considering the facts and circumstances as noted above, this application is allowed.

Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only), with two sureties of the like amount, each to the satisfaction of learned Judicial Magistrate 1st Class, Katihar in Kursela P.S. Case No. 68 of 2021.
