JUSTICE DINESH KUMAR SINGH ORAL ORDER 15-01-2015 Petitioner is languishing in custody since 03.02.2014 in a case registered for the offences punishable under Sections 302, 120B of the I.P.C and 27 of the Arms Act. Accusation is killing the brother of the informant. The name of the petitioner sprang up on the confession of co-accused Sujeet Kumar Mehta.
It is submitted by learned counsel for the petitioner that informant claims to identify the criminals but the petitioner has not been put on T.I.P. It is further submitted that co-accused with similar accusations have been granted bail vide Cr. Misc. No. 27688 of 2014 and analogous cases. Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
Patna High Court Cr.Misc. No.30949 of 2014 (3) dt.15-01-2015 2/2 Magistrate, Aurangabad in connection with Amba P.S. Case No. 08 of 2014.
Since petitioner is involved in two other cases, let learned Court below cancel the bail bonds of the petitioner, if the petitioner defaults for two consecutive occasions during trial.
