The present application has been filed for restoration of Cr.Misc.1577 of 2015 which stood dismissed for want of prosecution vide order dated 20.6.2016.

Learned counsel for the petitioner has submitted that while he was arguing in another court, the case was called out and, as such, he could not attend the court and the case was dismissed for non-prosecution.

On the facts and in the circumstances of the case, the prayer is allowed.

The Registry is directed to restore Cr.Misc. No.1577 of

Patna High Court Cr.Misc. No.29331 of 2016 (2) dt.20-06-2016 2/2 2015 to its original file.
