The petitioners seek bail in a case registered under Sections 147, 448, 341, 323, 325, 379, 307 and 504 of the Indian Penal Code.
The prosecution case in short is that while the informant along with his family members was sitting in his house, the accused persons forming unlawful assembly variously armed came there and started abusing. On protest, the accused persons assaulted the members of prosecution party, as a result of they sustained injuries.
It has been submitted on behalf of the petitioners that the
Patna High Court CR. MISC. No.49531 of 2019(2) dt.09-08-2019 2/2 petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 14-02-2019. Charge sheet has already been submitted. The nature of injury is said to be simple. No offence u/S 307 of the Indian Penal Code is made out.
On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Akbarpur P.S. Case No. 273 of 2018.
