The petitioner has preferred this application for grant of regular bail in a case registered under sections 448, 354 and 354B of the Indian Penal Code, section 3(i)(xi) of the S.C. and S.T.(POA) Act and sections 8 and 12 of the POCSO Act. As per the prosecution case, the petitioner is alleged to have outraged the modesty of the 14 year old niece of the informant.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case for oblique reasons. The allegations are false and concocted. He is in custody since 28.7.2021 and investigation in the case has concluded. He has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner in the F.I.R., the period in custody of 9 months and the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Ahiyapur P.S. Case no.498 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge VI-cum-Special Judge, POCSO Act, Muzaffarpur.
