2. The petitioner seeks regular bail in connection with Ismailpur P.S. Case No. 82 of 2025 for the offence registered under Sections 21 (a), 22(a) of the N.D.P.S. Act.
3. As per prosecution, total 600 ml cough syrup containing Codeine Phosphate & Triprolidine Hcl. Syrup was recovered from the house of the petitioner.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. The petitioner purchased the seized medicines for his ailing father and mother. The petitioner is not involved in illicit business of manufacturing, transporting or selling the cough syrup. There is no recovery from the conscious
Patna High Court CR. MISC. No.51316 of 2025(2) dt.11-08-2025 2/2 possession of the petitioner. There is no violation of mandatory provision of N.D.P.S. Act. The seized quantity comes below the commercial quantity. Petitioner is in custody since 09.05.2025 having no criminal antecedent. Petitioner undertakes to cooperate in the investigation and trial of the case.
5. Learned counsel appearing on behalf of the State opposes the prayer for grant of bail to the petitioner.
6. Considering the submissions on behalf of the parties and the facts and circumstances of the case, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned concerned court below in Ismailpur P.S. Case No. 82 of 2025.
