JUSTICE SHIVAJI PANDEY ORAL ORDER 26-07-2016 Heard learned counsel for the petitioners and counsel for the State.

In this case, the petitioners are apprehending their arrest in connection with Sasaram (M) P.S. Case No. 1185 of 2015 for offence under Section 366-A of the Indian Penal Code. The petitioner no.1 is brother and petitioner no.2 is mother of accused Gautam Kumar. The statement under Section 164 of the Cr.P.C. of the victim girl shows that she, on her own volition, had entered into marriage with Gautam Kumar. Looking to the entire facts and circumstances of the case, let the petitioners, namely, Subhas Kumar and Lakhmuna Devi, in the event of their arrest or surrender before the court

Patna High Court Cr.Misc. No.28685 of 2016 (2) dt.26-07-2016 below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Rohtas at Sasaram in connection with Sasaram (M) P.S. Case No. 1185 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, they will remain present and if they would not present themselves, the privilege of grant of anticipatory bail shall be deemed to have been cancelled.
