The petitioner seeks regular bail in connection with Brahampur P.S. Case No. 436 of 2018, registered for the offence punishable under Sections 25(1)(a), 26 and 30 of the Arms Act.

The allegation is regarding recovery of 20 pieces of swords from the shop of the petitioner.

The learned counsel for the petitioner submits that the said swords were kept for the purposes of being sold for Muharram festival. It is further submitted the co-accused person, namely, Sheo Shankar Sharma from whose possession, 94 pieces of swords were recovered, has already been granted bail by a coordinate Bench of this Court vide

Patna High Court Cr.Misc. No.72446 of 2018(2) dt.13-12-2018 2/2 order dated 04.12.2018 passed in Criminal Miscellaneous No. 70755 of 2018. Lastly, it is submitted that the petitioner is having a clean antecedent and he is languishing in custody since 19.09.2018.

Having regard to the facts and circumstances of the case as also the fact that similarly situated co-accused person has been allowed bail by this Court, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Brahmpur P.S.
