JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-02-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 307/34 and other ancillary sections of the Indian Penal Code to which section 302 IPC was added later on.

As per the prosecution case, on the order of this petitioner, co-accused Upendra Singh caught hold the neck of the victim, who was paralysis patient, and forcibly dashed his head with the wall causing his death during course of treatment.

Learned counsel for the petitioner submits that at best petitioner can be said to be order giver. There is land dispute between the parties. Petitioner has claimed clean antecedent and he is in custody since 10.8.2021.

Considering the aforesaid facts and circumstances of

Patna High Court CR. MISC. No.63558 of 2021(2) dt.21-02-2022 2/2 the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class, Gopalganj in Baikunthpur Police Station Case No. 191 of 2020.
