JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-09-2019 This application, for grant of anticipatory bail, arises out of Siwan Muffasil (Dhanauti O.P.) P.S. Case No. 37 of 2019, disclosing offences under Sections 336A/34 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping the minor daughter of the informant.

Submission of learned counsel for the petitioner is that the girl has been recovered and her statement under Section 164 Cr.P.C. has been recorded, in which, she has disclosed her age as 19 years and also stated that she had gone with the petitioner to Gujarat out of her own will and she wants to reside with the petitioner.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts,

Patna High Court CR. MISC. No.56058 of 2019(2) dt.04-09-2019 2/2 this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Siwan Muffasil (Dhanauti O.P.) P.S. Case No. 37 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
