Petitioner seeks bail in a case registered for the offence punishable under Section 302 of the Indian Penal Code. Allegation is that the petitioner was seen fleeing from the house of the informant in the night at 2.00-3.00 A.M., hence, he was suspected that he had committed murder of the Bhabhi of the informant.

Submission is that the petitioner is in custody since 08.10.2020. Besides aforesaid claim of the informant, there is no other material against the petitioner. Informant appears to be highly unbelievable.

Considering the facts aforesaid and completion of investigation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand)

Patna High Court CR. MISC. No.10169 of 2021(3) dt.13-08-2021 2/2 with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Banmankhi Police Station Case No.282 of 2019 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
