JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-12-2018 The petitioner seeks regular bail in connection with Patna Junction (Gulzarbagh) P.S. Case No. 111 of 2018, registered for offences punishable under Sections 498A and 302/34 of the Indian Penal Code.
Petitioner happens to be mother in law of the deceased and allegation against her and others is of causing dowry death of the deceased.
It has been submitted on behalf of the petitioner that she is mother in law of the deceased and no specific allegation has been attributed to the petitioner and co-accused, who is the father in law of the deceased has already been enlarged on bail by a coordinate Bench of this Court vide order dated 05.09.2018 passed in Cr. Misc. No. 51696 of 2018.
Patna High Court Cr.Misc. No.70192 of 2018(2) dt.06-12-2018 2/2 Learned counsel for the State as well as informant opposed the prayer for bail on the ground that one of the witnesses has stated that he has seen three persons throwing the lady (deceased ) on the railway track and, hence, the petitioner does not deserved to be enlarged on bail. Having heard both sides, considering the fact that coaccused, who is the father in law of the deceased has already been enlarged on bail and further the petitioner is a lady, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, (Railway), Patna, in connection with Patna Junction (Gulzarbagh) P.S. Case No.
111 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
