The petitioner has filed the instant application for grant of regular bail in connection with Laheriasarai P.S. Case No. 139 of 2022 registered under Sections 447, 341, 323, 324, 326, 307, 506 and 34 of the Indian Penal Code. Allegation against the petitioner is of assaulting to the informant's son, namely, Tuntun Thakur due to which he sustained injury.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He has falsely been implicated in this present case. Earlier there is a scuffle took place between the petitioner and informant's son

Patna High Court CR. MISC. No.53084 of 2022(3) dt.17-01-2023 2/2 due to which the petitioner has falsely been made accused in this present case. There is a case and counter case, members of both sides have sustained injuries as alleged in separate occurrence. As per injury report of injured Tuntun Thakur, which is annexed with the case diary shows that no any abnormalities detected by Radiologist of D.M.C.H. It is further submitted that the petitioner is languishing in judicial custody 28.3.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Laheriasarai P.S. Case No. 139 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Darbhanga.
