2. Petitioners seek regular bail in a case registered for the offences punishable under Sections 103(1) and 238 of the BNS and Section 27 of the Arms Act.

3. As per prosecution case, on 28.02.2025 at about 09:00 P.M., son of the informant left his house for attending a marriage ceremony but did not return. On the next date, he received a call from the police that his son has been killed by unknown persons.

4. Learned counsel for the petitioners submits that petitioners are not named in the FIR. Names of the petitioners transpired during the course of investigation in the confessional

Patna High Court CR. MISC. No.53680 of 2025(3) dt.20-11-2025 2/2 statement of co-accused Rahul Kumar. Similarly situated other co-accused persons have already been granted bail regular bail by difference co-ordinate Benches of this Court vide orders dated 06.08.2025, 04.09.2025, 31.10.2025 and 09.10.2025 passed in Cr. Misc. No. 36481 of 2025, Cr. Misc. No. 46632 of 2025, Cr. Misc. No. 46072 of 2025 and Cr. Misc. No. 62085 of 2025 respectively. Charge-sheet has already been submitted. Petitioners claim clean antecedent and they are in custody since 06.03.2025.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of allegation, clean antecedent and period of custody, the bail application is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate-1st Class, Saran at Chapra in connection with Jalalpur P. S. Case No. 39 of 2025.
