Petitioners, in the present case, are seeking regular bail in connection with Ghosi P.S. Case No. 431/2020 registered for the offence under Sections 341, 323, 325, 307, 379, 504 and 506 of the Indian Penal Code.

Learned counsel for the petitioners submits that both the parties are close door neighbours and gotias and they had a quarrel on some petty issue in which the petitioners are said to be have assaulted the prosecution side. Learned counsel submits that petitioners are in custody since 25.09.2020 having no criminal antecedent.

Learned A.P.P. for the State has opposed the prayer for

Patna High Court CR. MISC. No.9909 of 2021(4) dt.08-04-2021 2/2 regular bail of the petitioners.

Having regard to the facts and circumstances of the case wherein it appears from the allegations made in the First Information Report that both the parties are close door neighbours and gotias and they had a quarrel on some petty issue in which the petitioners are said to be have assaulted the prosecution side, the submission being that the petitioners have also suffered injury though simple in nature, both the petitioners have remained in jail for five months in connection with the present case and the occurrence seems to have taken place on the spur of moment without pre-mediation of mind, the petitioners have otherwise no criminal antecedent and they have not misused the privilege of provisional bail earlier granted to them, this Court confirms the bail earlier granted to the petitioners vide order dated 26.02.2021 Let the petitioners above-named remain on bail on the same bail bond.
