JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 3 23-07-2015 Heard learned counsel for the petitioner. Despite repeated calls, none appears on behalf of the State. The petitioner seeks anticipatory bail in connection with Bathnaha P.S. Case No. 122 of 2014 registered under Sections 341, 323, 447, 452, 379, 354, 307, 504 and 506 read with 34 of the Indian Penal Code.
It is contended that though the alleged occurrence is said to have taken place on 12.04.2014, the police was informed regarding the occurrence on 20th April, 2014 for which the formal FIR was instituted on 22nd April, 2014. Regard being had to the delay caused in informing

No.13825 of 2015 (3) dt.23-07-2015 2 / 2 the police and institution of the FIR, in the event of arrest or surrender in the court below within a period of six weeks from today, the petitioner is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Bathnaha P.S. Case No. 122 of 2014 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
