Let the defect (s), as pointed out by the office, be removed within a period of four weeks from the date of resumption of physical filing and physical removal of defect. This application has been filed for modification of the order dated 05.08.2022 passed in Cr. Misc. No.21471 of 2022 by this Court by which the petitioner has been granted bail subject to certain conditions.
Learned counsel for the petitioner submits that the petitioner has been granted bail vide order dated 05.08.2022 with certain conditions including condition no. (i) One of the bailors will be Gorakh Paswan, maternal uncle of the petitioner,
Patna High Court CR. MISC. No.50838 of 2022(2) dt.29-09-2022 2/2 who has sworn the affidavit in this case. Learned counsel further submits that the said Gorakh Paswan produced the document of land with affidavit, which is recorded in his father's name as surety, but the learned court below did not accept the surety due to the fact that aforesaid land is not recorded in his name. In such view of the matter, the order dated 05.08.2022 is modified to the extent only that one of the bailors will be Sambhu Paswan, cousin maternal uncle of the petitioner, who has sworn the affidavit in the present modification application.
