The petitioner has filed the instant application for grant of regular bail in connection with Deepnagar P. S Case no. 256 of 2020 registered under section 379 of the Indian Penal Code.

As per allegation in the FIR, it is stated by the informant that on getting up in the morning she found her tractor along with the trailor which was parked infront of her house, missing. One person could be seen in a suspicious circumstance in the CCTV footage.

It is submitted by learned counsel for the petitioner that except for the name of the petitioner having transpired in the confessional statement of co-accused Lakshman Rajak made before police, there is no other material against him. No

Patna High Court CR. MISC. No.1553 of 2021(3) dt.02-02-2021 2/2 recovery of any incriminating article has taken place from his possession. The only material against the petitioner is of his having been implicated in similar matters in the past. Petitioner is in custody since 28.10.2020 and charge sheet in the case has been submitted.

The application for bail is opposed by learned counsel for the State.

Having heard learned counsel for the parties and in the facts and circumstances of the case including the submissions made on behalf of the petitioner and charge sheet in the case having been submitted, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Deepnagar P. S Case no. 256 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif.
