The petitioner seeks bail in Bheja P.S. Case No. 33 of 2018, registered under Sections 147, 148, 149, 341, 323, 324, 325, 354, 448, 307, 302 and 504 of the Indian Penal Code. Referring to the contents of the FIR, learned counsel for the petitioner contends that there is no allegation against him of assaulting any person, though such allegation is specific against other co-accused persons. He has also submitted that similarly circumstanced co-accused, Uday Mukiya has been granted bail by this Court by order dated 10.09.2018, passed in Cr. Misc. No. 43945 of 2018 and another co-accused Pramod Mukhiya has also been granted bail by this Court by order dated 26.09.2018, passed in Cr. Misc. No. 47739 of 2018.

No.70281 of 2018(2) dt.04-12-2018 2/2 Considering the said submissions and the fact that the petitioner has no criminal antecedent, coupled with the fact that other co-accused persons have been granted bail by this Court, this application is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned ACJM, Jhanjharpur, Madhubani in Bheja P.S. Case No. 33 of 2018.
