ANJANA MISHRA ORAL ORDER 23-08-2016 Learned counsel for the petitioner is permitted to make necessary correction deleting the word "no" in paragraph 3 of the present application.

Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Rahui P.S. Case No.257 of 2015 registered for the offence under Sections 147, 149, 341, 323, 307, 504 and 506 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that there is a history of litigations between the parties and the allegation, as is evident from the F.I.R., is against two other co-accused persons and not against this petitioner.

No.26622 of 2016 (3) dt.23-08-2016 2/2 Having perused the materials on record and also that paragraph 4 indicates that there was dispute between the parties, as a result of which cases were lodged in which other accused persons, including the petitioner, are on bail, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Rahui P.S. Case No.257 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
