JUSTICE ASHUTOSH KUMAR ORAL ORDER 20-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Ram Krishna Nagar P.S. Case No. 246 of 2017, dated 29.08.2017, instituted for the offences under Section 379 of the Indian Penal Code. A Bolero vehicle was stolen and in search of which, one Md. Aslam was arrested. No.72758 of 2018(2) dt.20-12-2018 2/3 for the petitioner has submitted that the petitioner is a class-IV employee in a private hospital, who in the past had an altercation with aforesaid Md. Aslam, who by profession is a tempo driver. Because of this dispute with the petitioner in the past, aforesaid Md. Aslam has unnecessarily named the petitioner in his confession. The falsity of the allegation further appears from the fact that the petitioner has clean antecedents.

Nothing has been recovered from the possession of the petitioner.

Considering the facts aforestated, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl.
