2. The present application has been preferred for modification of the order dated 09.12.2024 in Cr. Misc. No. 80388 of 2023.
3. On 07.10.2023, Cr. Misc. 59775 of 2023 was allowed with a direction to surrender within a period of four weeks and if the same is done, to be released on bail.
4. The Cr. Misc. No. 80388 of 2023 thereafter was preferred in which it was the stand of the petitioner that the name of the father of the petitioner no. 2, Rajesh Yadav has been wrongly mentioned. It was accordingly allowed on 09.02.2024 and
Patna High Court CR. MISC. No.62058 of 2024(2) dt.30-08-2024 2/2 the changes were made.
5. This followed Cr. Misc. No. 26126 of 2024 which came to be disposed of on 03.05.2024 when the learned counsel for the petitioner submitted that some wrong facts have been incorporated in the petition and as such, he may be permitted to withdraw the case.
6. Now, the fourth petition in continuation of which, this is the third modification petition.
7. Now, the contention is that, name of the informant has been wrongly typed as Pratima Kumari and it should be Shiv Kumar Prasad.
8. The FIR is of 18.01.2023, the allegation against other is under Section 307 of the IPC and 27 of the Arms Act. The way the petitioners have carelessly pursued the case, this Court now has no option but to reject the present modification petition with a cost of Rs. 1,000/- to be paid to Patna High Court Legal Services Committee.
9. Accordingly, the Cr. Misc. No. 62058 of 2024 stands rejected.
